By accessing and using the services provided by brightvertexora Ltd ("Company", "we", "us", or "our"), you ("Client", "you", or "your") agree to be bound by these Terms of Service ("Terms"). These Terms govern your use of our industrial equipment leasing services and our website brightvertexora.top.

If you do not agree with any part of these Terms, you must not use our services. Your continued use of our services constitutes acceptance of any modifications to these Terms.

Services Description

brightvertexora provides industrial equipment leasing services, including but not limited to heavy machinery, power tools, safety equipment, and related accessories for construction and infrastructure projects. All equipment is provided subject to availability and these Terms.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice, except where such changes would materially affect existing lease agreements.

Equipment Leasing Terms

Equipment leasing is subject to the following conditions:

• All equipment remains the property of brightvertexora throughout the lease period
• Equipment must be used only for its intended purpose and in accordance with manufacturer guidelines
• Clients are responsible for the safe operation and basic maintenance of leased equipment
• Any damage beyond normal wear and tear will be charged to the client
• Equipment must be returned in the same condition as received, allowing for reasonable wear
• Lease periods and rates are as specified in individual lease agreements

Client Responsibilities

As a client of brightvertexora, you agree to:

• Provide accurate and complete information when requesting equipment leasing services
• Use equipment only for lawful purposes and in compliance with all applicable regulations
• Ensure that all operators are properly trained and qualified to use the equipment
• Maintain appropriate insurance coverage for the leased equipment and operations
• Report any equipment malfunctions or damage immediately
• Pay all fees and charges in accordance with the agreed payment terms
• Return equipment on time and in acceptable condition

Payment Terms

Payment terms are specified in individual lease agreements. Generally, payment is required in advance for short-term rentals and may be structured differently for long-term leases. Late payments may incur additional charges as specified in the lease agreement.

All prices are quoted in Euros and include applicable VAT unless otherwise stated. We reserve the right to adjust prices with reasonable notice for future bookings.

Intellectual Property

All intellectual property rights in our website, services, equipment designs, documentation, and related materials remain the exclusive property of brightvertexora or our licensors. You may not reproduce, distribute, modify, or create derivative works from any of our intellectual property without express written permission.

The brightvertexora name, logo, and all related trademarks are owned by brightvertexora Ltd and may not be used without our prior written consent.

Limitation of Liability

To the maximum extent permitted by law, brightvertexora's liability for any claims arising from or related to our services is limited to the total amount paid by you for the specific equipment lease giving rise to the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Insurance and Indemnification

Clients are required to maintain comprehensive insurance coverage for leased equipment and related operations. You agree to indemnify and hold harmless brightvertexora from any claims, damages, or expenses arising from your use of our equipment, except where such claims result from our negligence or breach of these Terms.

Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms that is due to fire, flood, earthquake, pandemic, government action, war, terrorism, or other causes beyond the reasonable control of such party.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Cyprus.

For EU residents, nothing in these Terms affects your statutory rights under applicable consumer protection laws.

Termination

Either party may terminate a lease agreement in accordance with its specific terms. brightvertexora reserves the right to terminate services immediately if you breach these Terms or use equipment in a manner that poses safety risks or violates applicable laws.

Upon termination, you must immediately return all leased equipment and pay any outstanding fees. Provisions relating to payment obligations, liability limitations, and intellectual property shall survive termination.

Modifications to Terms

We may modify these Terms from time to time by posting updated terms on our website. Material changes will be communicated to existing clients with reasonable notice. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remainder of these Terms shall remain in full force and effect.
